Sharing Inheritence
Question:
السلام عليكم ورحمة الله وبركاته
My aunt worked for approximately 23 years and during the years she was working, she had a joint bank account with her husband. All their wealth (money and house) was under both the wife and husband’s name.
My question is, if her husband passes away before her, how would that wealth be divided considering a significant portion of the earnings belongs to my aunt? She is unsure of how much exactly belongs to her. Also, the husband’s parents are not living, but his brothers, sisters and non-Muslim daughter are still alive.
Answer:
وعليكم السلام ورحمة الله وبركاته
Shaykh Adel said that if the situation is like this, the husband died and the brothers and sisters are Muslims, they will be entitled to take their share from this money from the account and if they were in a kaafir country and even if they are not Muslims, by law they will take their share.
So the best situation here is that she calculates her share, approximately that she has in this account and she withdraws her money from the account. The portion of the house which is hers he can write it for her and not leave it for inheritance because if he leaves it for inheritance she will not get her fair share.
